Looks like (Erben’s) photos of Errol from his 1933 adventure on the South Seas are making their way onto the internet. Those are fantastic photos!

Mr Fegerl holds the copyright. They’re from his book. Nobody has a right to reproduce them.

To help us all understand what you’re saying, Inga, who is Mr. Fegerl and how is it he came to own & copyright photos of Errol Flynn?? Did he personally know Hermann Erben? Or is that just an “Erben Myth”?

Please remove the photos from your comment, Tim. As every Flynn fan knows, Mr Fegerl is the author of a famous book on the friendship of Erben and Flynn. He knew Erben personally and is in possession of his photos, of which he owns the copyright.

Not every Flynn fan knows that, Inga. From my experience, most Flynn fans never heard of either him or his book. And very, very few have ever actally seen or read his book.

The copyright notice you give is just standard language, Inga. I don’t see it tied to any specific photos. Moreover, the images I posted have no “watermarks” or copyright notices attached to them. Finally, I see no special release authorization connected to the image(s) Robert posted.
What would like to see is a document confirming that these images are lawfully copyrighted. If I see that, I will remove the images proved to be protected by international law. A mere statement, especially in a very rarely seen self-published book. does not constitute such proof.
Mr./Herr Fergerl should also consider that releasing these photos, to either the public-at-large, or at least a publicly-accessiblle historical collection is in the best interests of Errol Flynn’s fans and legacy.

The images I posted above, Inga, are available within seconds on the net, without any copyright notice whatsoever. As with the ones below, I personally have never seen any copyright restriction on their publication. Indeed, at least one of them (and I believe more) have been published on the EFB. So, I’ll need further further, more explicit copyright information before I pull down the photos I’ve posted. Morever, I’m sure Errol would want these 80-year-old photos made available to all his fans, not just ones who can pay hundreds of dollars to see them. How exactly does that benefit Errol’s legacy, fans & historians, Inga??
Sad that you’re pushing this so hard, Inga. Seems personal, as you’ve never done so before to anyone previously. It’s also very notable that you’re videos are full of uncredited copyright images, that you refuse to edit or pull down. Why for others but not for you?

All I can say is that I am personally in contact with Mr Fegerl and that I would not recommend you risking anything. He does follow the blog and he will not be very happy about the reproduction of these photos. Robert had his special permission to publish the photos.

If you provide evidence that the photos I posted are protected by copyright, I will take them down. I have personally never seen any such evidence.
I must add here, too, how amazingly ironic and even humorous it is to see people invoking the (very questionable) protection of international copyright law on photos of a public figure taken by Herr Hermann Erben, a pathetic scam-artist who notoriously flouted international law most every day of his life -and causing Errol and his family much grief for doing so. Don’t expect any sympathy or respect for Erben from me.

I quote from the book: “All rights reserved. No part of this publication may be reproduced, stored on a retrieval system, or transmitted, in any form, or by any means, electronic, mechanical, photocopying, recording or otherwise, without the prior permission of the publisher. Josef Fegerl Ges.m.b.H.” This means that all photos from this book which you can find on the internet have been illegally posted there, including the ones here on the blog. Only Robert has a special permission as it’s part of his work for his book.

By the way, Inga, here’s one of many readily-available sites that incude copies of photos I have posted, without any watermarking or copyright notices. This article also presents information demonstrating how terribly harmful Hermann Erben’s criminal conduct around the world has been to Errol. A “Bad Hat” indeed.

Somewhere on the blog is a legal disclaimer concerning the use of images on this blog. As this is a blog, it is a journalistic effort, and a discussion group. Images used in our context are considered covered under the Fair Use Laws of the United States. In this context we are allowed to use copyrighted images to illustrate our posts, as long not too many images are used, and none are offered for sale, or any other commercial purpose without the copyright holder’s written permission. If Mr. Fegerl asks us to remove any of his images we will do so as a courtesy to him, not as a legal obligation. It would be a shame, however to lose them and the discvussion of them which would reduce the quality of the blog, and withdraw publicity for the book and credit due Mr. Fegerl for his hard work. Mr. Fegerl is a kind and generous man, and I hope we will not be asked to remove any of his images from this blog. I see no reason to disgus this further until we hear from Mr. Fegerl.
